The Oui Chef service ("Oui Chef") is an online recruitment social network for the hospitality sector provided by Oui Chef Recruitment Ltd. ("Us", "We", "Our") to you ("You", "Your"). Oui Chef comprises of the website hosted at https://www.ouichef.jobs and the progressive web application ("PWA") hosted at https://app.ouichef.jobs.

Oui Chef is currently still undergoing development and any of its aspects, including these Terms and Conditions, may undergo significant changes without any notice. Oui Chef is intended to provide safe, inclusive and positive environment for all its users (the Oui Chef "Spirit") and you acknowledge and agree to abide by this Spirit.

Access

We agree to provide You with access to Oui Chef ("Access") and You may access and use Oui Chef only if You are eligible to be bound by these Terms and Conditions and You agree to them. In any case, you must be at least 13 years old to access and use Oui Chef. You agree to use your Access with care and responsibility, and not to misuse, temper with, or otherwise interfere with your Access or any other elements of Oui Chef.

We reserve the right to withdraw your Access at any time, without notice, at our sole discretion.

We also reserve the right not to provide You with Access, temporarily or permanently, in particular during the current period of product and service development.

Your Account

You need to create a user account ("Account") to access Oui Chef. The Account creation process involves You providing us with a valid email address belonging to You. We adopt a verification process of Your email address as a mandatory condition for You to interact with, or post updates on Oui Chef. You agree to complete this verification process responsibly and not to abuse, or otherwise temper with it. You acknowledge that the verification process includes us obtaining information about the email address You provide, and that we may use this information to contact Your email service provider in case of any illegal activity appearing to be associated with Your Account. We reserve the right to temporarily or permanently block Your email address from creating or accessing your Account or Oui Chef.

Privacy and Cookies

We take Your right to privacy very seriously and handle all information and data You share with us directly or by Your accessing and using Oui Chef with great care. You consent to our collection and use of this information and data. For further details please see our Privacy and Data Policy.

Content

Oui Chef is an online recruitment social network intended to provide a safe, inclusive and positive content platform for user-submitted content ("Content").

You agree to only submit Content You own, related to Your professional work or business in the hospitality sector, in accordance with the Oui Chef Spirit. Content containing any form of advertising or product placement is not allowed on Oui Chef, unless it is posted by a sponsor account.

You are solely responsible for any Content You provide and Your access of any Content on Oui Chef. You acknowledge Your full responsibility to comply with applicable laws, rules and regulations. This includes, but is not limited to, You being responsible for any Content you post on Oui Chef being owned by You and You having, or having obtained, the rights to post the Content on the Oui Chef platform subject to these Terms and Conditions. We reserve the right to remove any Content deemed or reported as infringing on copyright, trade marks or other rights held by other parties, Content violating our Content guidelines or the Oui Chef Spirit, or is otherwise deemed inappropriate.

You retain ownership of your Content posted on Oui Chef, but by posting You grant Us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, publish, reproduce and distribute Your Content or derivatives of it. This includes, but is not limited to, Our making the Content available to the public or Us using the Content, or derivatives of it, for promotional purposes. You can end this license anytime by deleting your Content or Account. However, Your Content will continue to appear if You shared it with others and they have not deleted it.

Limitations of Liability

Your access to, and Your use of Oui Chef is solely at Your own risk. You understand and agree that Oui Chef is provided to You on an “AS IS” and “AS AVAILABLE” basis.

We make no warranty or representation and disclaim all responsibility and liability for: (i) the completeness, accuracy, availability, timeliness, security or reliability of Oui Chef or any Content; (ii) any harm to Your computer system, device used for Access, loss of data, or other harm that results from Your Access to or use of Oui Chef or any Content; (iii) the deletion of, or the failure to store or to transmit, any Content and other communications maintained by Oui Chef; and (iv) whether Oui Chef will meet Your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from Us or through Oui Chef or any Content, will create any warranty or representation not expressly made herein.

We cannot guarantee that Oui Chef will always function as intended, without disruptions, delays or outages, however, we will use reasonable skill and care in providing Oui Chef. You acknowledge and agree that we cannot be responsible or held liable for any losses incurred by Oui Chef, Your posting or Access of Content.

By using Oui Chef You agree that Oui Chef Recruitment Ltd., its parents, affiliates, related companies, officers, directors, employees, agents representatives, partners and licensors, liability is limited to the maximum extent permissible in Your country of residence.

Transfer

We reserve the right to transfer, assign or sub-contract the whole or part of any of Our rights or obligations under these Terms and Conditions or any related contract to any third party.

If any part of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these Terms and Conditions shall not be affected.

Ending these Terms and Conditions

You or We may end this legal agreement and these Terms and Conditions by You deleting Your account or Us withdrawing Your Access.
